Beware! You have these rights, but you have to decide if and when you want to use them. Sometimes if you don't answer the police, they'll hold you longer or retaliate against you. But if you do answer questions about your immigration status, you could be giving the police information that ICE can later use to deport you. ¡Tenga cuidado! What are my rights?

Under Secure Communities fingerprints taken by police are sent to ICE automatically. ICE then decides whether it wants to ask police to hold the individual for them after they are released from criminal custody (via a "detainer") or notify them prior to release. Some police agencies have an agreement with ICE to participate in the 287(g) program in which local or state police are deputized to perform the functions of federal immigration agents.
